Please read these Terms of Service (“Terms”) carefully before using the pristineaquatics.com website or engaging Pristine Aquatics for aquarium services. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. About Our Services
Pristine Aquatics provides professional aquarium maintenance, setup, consulting, and related services ("Services") to residential and commercial clients in Michigan. These Terms govern both your use of our website and any service agreements entered into between you and Pristine Aquatics.
2. Website Use
Acceptable use
You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to:
- Use the website in any way that violates applicable local, state, or federal laws
- Transmit any unsolicited or unauthorized advertising or promotional material
- Attempt to gain unauthorized access to any part of the website or its servers
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the website
Intellectual property
All content on this website — including text, graphics, logos, images, and software — is the property of Pristine Aquatics and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
3. Service Agreements
Quotes and estimates
Any quotes or estimates provided by us are valid for 30 days from the date of issue unless otherwise specified. A quote does not constitute a binding contract. Services commence only upon written or verbal confirmation and receipt of any required deposit.
Scheduling and access
You agree to provide safe and reasonable access to your aquarium and premises at scheduled service times. If access is not available at the scheduled time, we reserve the right to charge a trip fee of $50 for the missed appointment.
Your responsibilities
Consultations and service estimates are provided free of charge for locations within 10 miles of South Lyon, MI. A trip fee of $50 applies for service locations outside of the 10-mile radius. This fee will be disclosed prior to scheduling.
You are responsible for:
- Providing accurate information about your aquarium, livestock, and equipment
- Disclosing any known issues, diseases, or hazards prior to service
- Ensuring your aquarium system and electrical setup are safely maintained
- Following any care instructions we provide between service visits
Livestock and equipment
While we take every reasonable precaution, the health of aquatic life is influenced by many factors outside our control including water chemistry fluctuations, disease, genetic predisposition, and existing livestock compatibility. We are not responsible for the loss of livestock or equipment failure unless directly caused by our negligence.
4. Payment Terms
Payment is due at the time of service unless a prior billing arrangement has been established in writing. We accept cash, Venmo, personal check, credit/debit card, and PayPal. Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month.
For new tank setups or large projects, we may require a deposit of up to 50% before work begins. Deposits are non-refundable if you cancel within 48 hours of a scheduled service.
5. Cancellations and Rescheduling
We ask for at least 24 hours notice for cancellations or rescheduling. Cancellations made with less than 24 hours notice may be subject to a cancellation fee equal to 50% of the scheduled service cost. Emergency cancellations due to genuine emergencies will be handled at our discretion.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Pristine Aquatics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of livestock, damage to property, or loss of revenue, arising out of or related to our services or your use of our website.
Our total liability to you for any claim arising from our services shall not exceed the total amount paid by you to Pristine Aquatics in the 30 days preceding the claim.
7. Indemnification
You agree to indemnify and hold harmless Pristine Aquatics, its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your breach of these Terms, your use of our services, or any misrepresentation you make to us.
8. Warranty Disclaimer
Our services are provided "as is" without any warranty, express or implied. We do not warrant that our services will meet your specific requirements or that any particular outcome will be achieved. We make no guarantees regarding the health or survival of aquatic livestock.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Michigan.
10. Dispute Resolution
We encourage you to contact us directly to resolve any disputes before pursuing formal legal action. Most issues can be resolved quickly and informally. If a dispute cannot be resolved through direct communication, both parties agree to attempt mediation before pursuing litigation.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised Effective Date. Your continued use of our website or services after such changes constitutes your acceptance of the new Terms.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
13. Entire Agreement
These Terms, together with any written service agreement, constitute the entire agreement between you and Pristine Aquatics regarding your use of our website and services, and supersede all prior agreements and understandings.
